These Terms and Conditions govern all charter and sea transfer services provided by Roko Nautika d.o.o. (trading as Maro Charter), OIB: 39838966704, Ribarska 1a, 51000 Rijeka, Croatia. By submitting a booking enquiry or signed charter contract, you agree to be bound by these terms.
1. Definitions
- "Maro Charter" — Roko Nautika d.o.o., OIB: 39838966704, Ribarska 1a, 51000 Rijeka, Croatia — operator of yacht charter and sea transfer services from Marina Novi Vinodolski.
- "Client" — the individual or group entering into a charter agreement or requesting a transfer service.
- "Charter" — the rental of a sailing or motor yacht for a specified period — either bareboat (self-skippered, requiring valid nautical and VHF licences) or skippered (with a professional captain provided by Maro Charter).
- "Transfer" — a point-to-point sea transport service using our patrol or speedboat vessels.
- "Booking Confirmation" — the written charter contract (Charter Party) and accompanying invoice issued by Maro Charter upon receipt of a deposit.
2. Booking & Confirmation
All bookings are subject to availability. A booking becomes binding only upon receipt of the signed charter contract and payment of the required deposit. An enquiry alone does not constitute a reservation. Charters typically commence and end on Saturdays; standard durations are 1, 2, or 3 weeks.
- A 30% deposit is required to confirm your charter reservation.
- The remaining balance is due no later than 30 days before the charter start date.
- Late payment may result in automatic cancellation without refund of the deposit.
- Bookings made within 30 days of departure require full payment at time of booking.
3. Cancellation Policy

Cancellations must be submitted in writing to info@marocharter.com. We strongly recommend comprehensive travel insurance covering charter cancellation. Under Croatian consumer law (Zakon o zaštiti potrošača), the statutory 14-day right of withdrawal does not apply to charter contracts with specific agreed dates (Art. 79(1)(l) ZZP).
4. Cancellation by Maro Charter
Maro Charter reserves the right to cancel or suspend a charter or transfer in the following circumstances:
- Adverse weather presenting a genuine safety risk (e.g. Bora force 7 or above, Jugo with high swells)
- Mechanical failure or damage to the vessel requiring repair before or during the charter
- Force majeure events (pandemic, port authority closure, acts of war) beyond our reasonable control
- Non-payment of the balance by the due date
In the event of cancellation by Maro Charter for weather or mechanical reasons, we will offer a full reschedule or a full refund of all amounts paid. We are not liable for any consequential costs including flights, accommodation, or other travel arrangements.
5. Licences & Documentation
Croatian law (Pravilnik o uvjetima i načinu obavljanja plovidbe, NN 137/21 and amendments) requires that at least one person aboard holds a valid nautical licence and a VHF radio operator's certificate for all charter vessels. For bareboat charters:
- Copies of all licences must be provided to Maro Charter before the booking is confirmed.
- Original licence documents must be aboard the vessel throughout the voyage.
- A certified crew list (popis posade) is mandatory; Maro Charter prepares this at check-in based on passport details provided.
- Any change of crew during the voyage must be reported immediately; a revised crew list must be issued.
- Clients who do not hold valid licences must book a skippered charter.
- Maro Charter accepts no liability for any fines, detentions, or costs resulting from the client's failure to carry valid documentation.
6. Conduct on Board
The captain (whether provided by Maro Charter or the client themselves) has absolute authority over the vessel and the safety of all persons aboard. Maro Charter reserves the right to terminate any charter without refund where conduct endangers the vessel or crew.
7. Liability & Insurance
All Maro Charter vessels carry full maritime insurance as required by Croatian law, including third-party liability and passenger liability cover. However:
- Maro Charter is not liable for personal injury or property loss resulting from the client's or guests' own negligence.
- We are not liable for delays or losses caused by weather, port authority decisions, or force majeure.
- Clients are strongly advised to arrange comprehensive personal travel, medical, and baggage insurance independently.
- Our total liability shall not exceed the total charter fee paid for the affected period.
8. What Is Included
Unless otherwise stated in the Booking Confirmation, all charters include:
- The vessel as specified, equipped and maintained to Croatian Maritime Authority standards
- Bed linen and towels
- Basic safety equipment (life jackets, flares, fire extinguisher, first-aid kit)
- Skippered charters: professional captain for the full duration
- Full pre-departure briefing on the vessel, safety equipment, and your route
- 24/7 sea assistance coverage via our Highfield Patrol 760 Rib
The following are not included unless explicitly stated in the Booking Confirmation:
- Fuel (settled at end of charter based on actual consumption)
- Marina and harbour fees
- National park entrance fees (e.g. Kornati)
- Food, beverages, and provisioning
- Fishing and diving permits
9. Sea Transfer Services
Transfer bookings are subject to the same deposit and cancellation terms as charters. Additionally:
- Prices are per transfer, not per person, unless explicitly stated otherwise.
- Luggage is limited to one soft bag per passenger; oversized items must be declared in advance.
- Transfer times are estimates and may be affected by sea conditions or port traffic.
- Maro Charter is not liable for missed flights, ferries, or onward connections caused by delays.
10. Governing Law
These Terms and Conditions are governed by the law of the Republic of Croatia. Any dispute arising from or in connection with these terms shall be submitted to the exclusive jurisdiction of the competent court in Rijeka, Croatia. EU consumers retain the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
